DISPOSITION: The Commission decided by a vote of 4-2 to take the following actions in MUR
7877:
1. Accept the conciliation agreement, as recommended in the Memorandum to the
Commission dated June 23, 2021.
2. Approve the appropriate letters.
3. Close the file.
The Commission failed by a vote of 3-3 to:
a. Open a MUR.
b. Find reason to believe that the Tennessee Democratic Party violated 52 U.S.C. § 30104(b)(2), (4) by failing to report total receipts and disbursements.
c. Find reason to believe that the Tennessee Democratic Party violated 52 U.S.C. § 30104(b)(3)(A) and 11 C.F.R. § 102.17(c)(8)(i)(B) by failing to itemize receipts received via joint fundraising transfers.
d. Find reason to believe that the Tennessee Democratic Party violated 52 U.S.C. § 30116(f) by knowingly accepting excessive contributions.
e. Find reason to believe that the Tennessee Democratic Party violated 11 C.F.R. § 106.7(d)(1) by failing to maintain monthly payroll logs.
f. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated July 27, 2020.
g. Approve the proposed Conciliation Agreement, as recommended in the First General Counsel’s Report dated July 27, 2020.
h. Approve the appropriate letters.
