DISPOSITION: The Commission failed by a vote of 2-4 to:
a. Find no reason to believe that Faith and Power PAC and Taylor Reed in their official capacity as treasurer violated 52 U.S.C. §§ 30104(b)(6)(B)(iii), (g)(3)(B) by improperly reporting independent expenditure information.
b. Dismiss the allegation that Faith and Power PAC and Taylor Reed in their official capacity as treasurer violated 52 U.S.C. § 30116(a) by making excessive contributions.
c. Dismiss the allegation that Senate Leadership Fund and Caleb Crosby in his official capacity as treasurer violated 52 U.S.C. § 30125(a) by soliciting, receiving, or directing funds that were not subject to the limitations and prohibitions of the Act.
d. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated November 17, 2020.
e. Approve the appropriate letters.
f. Close the file.
The Commission decided by a vote of 4-2 to:
a. Find no reason to believe that Faith and Power PAC and Taylor Reed in their official capacity as treasurer violated 52 U.S.C. § 30104(b)(6)(B)(iii) or 52 U.S.C. § 30104 (g)(3)(B) by improperly reporting independent expenditures.
b. Find no reason to believe that Faith and Power PAC and Taylor Reed in their official capacity as treasurer violated 52 U.S.C. § 30116(a) by making excessive contributions.
c. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated November 17, 2020, subject to the edits last circulated by the Republican Commissioners’ Offices on December 9, 2022 at 12:07 p.m., and further subject to the edits discussed by the Office of General Counsel at the table.
d. Close the file.
e. Issue the appropriate letters.
