DISPOSITION: The Commission decided by a vote of 5-0 to take the following actions in MUR 7678:1. Accept the conciliation agreement with Keisha Carter, as recommended in the Memorandum to the Commission dated May 1, 2024.2. Take no further action as to the allegations that Keisha Carter knowingly and willfully violated 52 U.S.C. §§ 30102(c) and (h) and 30104(b) by failing to keep accurate records and file accurate reports of receipts and disbursements.3. Dismiss the allegations that Keisha Carter converted campaign funds to personal use in violation of 52 U.S.C. § 30114(b)(1).4. Approve the appropriate letters.5. Close the file effective 30 days after the date the certification of this vote is signed (or on the next business day after the 30th day, if the 30th day falls on a weekend or holiday).
The Commission decided by a vote of 5-0 to:Find probable cause to believe that Keisha Carter in her personal capacity knowingly and willfully violated 52 U.S.C. § 30102(h)(1) and 11 C.F.R. § 103.3 by failing to deposit receipts in or make disbursements from an account at a properly designated campaign depository, and knowingly and willfully violated 52 U.S.C. § 30102(b)(3) and 11 C.F.R. § 102.15 by failing to keep campaign funds segregated from the personal funds of any individual.

The Commission decided by a vote of 6-0 to take the following action in MUR 7678:1. Find reason to believe that Keisha Carter in her personal capacity knowingly and willfully violated 52 U.S.C. § 30102(h)(1) and 11 C.F.R. § 103.3 and knowingly and willfully violated 52 U.S.C. § 30102(b)(3) and 11 C.F.R. § 102.15. 2. Approve the draft Factual and Legal Analysis with respect to Keisha Carter, as recommended in the Second General Counsel’s Report dated August 10, 2023.3. Authorize the Office of General Counsel to engage in pre-probable cause conciliation for a period not to exceed 30 calendar days after the issuance of the letters to other respondents.4. Direct the Office of General Counsel to draft a proposed conciliation agreement for Keisha Carter that includes a knowing and willful finding and admission for the Commission’s reason to believe finding with an appropriately calculated penalty based on the knowing and willful finding, and to circulate the draft agreement on tally.5. Approve the appropriate letters.
