DISPOSITION: The Commission failed by a vote of 2-4 to:
a. Dismiss the allegation that National Association of Realtors Political Action Committee and Nancy M. Lane in her official capacity as treasurer violated 52 U.S.C. §§ 30116(a) and 30104(b) by making and failing to report excessive in-kind contributions in the form of coordinated communications.
b. Dismiss the allegation that the Committee to Elect Leigh Brown and Joseph Clark in his official capacity as treasurer violated 52 U.S.C. §§ 30116(f) and 30104(b) by receiving and failing to report excessive in-kind contributions from the National Association of Realtors Political Action Committee in the form of coordinated communications.
c. Dismiss the allegation that Leigh Brown violated 52 U.S.C. § 30116(f) by receiving excessive in-kind contributions from the National Association of Realtors Political Action Committee in the form of coordinated communications.
d. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated December 3, 2019, subject to the edits circulated by the Democratic Commissioners on the paragraph setting forth coordination standards on page 8 between lines 7-14.
e. Approve the appropriate letters.
f. Close the file.
The Commission decided by a vote of 5-0 to:
a. Find no reason to believe that National Association of Realtors Political Action Committee and Nancy M. Lane in her official capacity as treasurer violated 52 U.S.C. §§ 30116(a) and 30104(b) by making and failing to report excessive in-kind contributions in the form of coordinated communications.
b. Find no reason to believe that the Committee to Elect Leigh Brown and Joseph Clark in his official capacity as treasurer violated 52 U.S.C. §§ 30116(f) and 30104(b) by receiving and failing to report excessive in-kind contributions from the National Association of Realtors Political Action Committee in the form of coordinated communications.
c. Find no reason to believe that Leigh Brown violated 52 U.S.C. § 30116(f) by receiving excessive in-kind contributions from the National Association of Realtors Political Action Committee in the form of coordinated communications.
d. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated December 3, 2019, subject to the edits as last circulated by the Democratic Commissioners on March 7, 2022 at 2:07 p.m.
e. Approve the appropriate letters.
f. Close the file.
The Commission decided by a vote of 6-0 to:
Amend the Factual and Legal Analysis and the certification and any other documents for technical and conforming edits to make changes to the treasurer as necessary.
