DISPOSITION: The Commission decided by a vote of 4-1 to take the following actions in MUR
7535:
1. Reopen MUR 7535.
2. Rescind findings 3(a) and 3(b).
3. Dismiss allegations that Leah Vukmir and Leah for Senate and Thomas Datwyler, in his official capacity as treasurer, violated 52 U.S.C. § 30125(e)(1)(A) by soliciting excessive contributions.
4. Dismiss allegations that Leah for Senate and Thomas Datwyler, in his official
capacity as treasurer, violated 52 U.S.C. §§ 30116(f) and 30104(b) by receiving
and failing to report excessive, prohibited in-kind contributions in the form of coordinated communications.
5. Close the file.
The Commission failed by a vote of 1-5 to:
a. Find reason to believe that Leah Vukmir and Leah for Senate and Travis Kabrick, in his official capacity as treasurer, violated 52 U.S.C. § 30125(e)(1)(A) by soliciting excessive contributions.
b. Find reason to believe that Leah for Senate and Travis Kabrick, in his official capacity as treasurer, violated 52 U.S.C. §§ 30116(f) and 30104(b) by receiving and failing to report excessive, prohibited in-kind contributions in the form of coordinated communications.
c. Find reason to believe that Richard Uihlein violated 52 U.S.C. § 30116(a) by making excessive in-kind contributions.
d. Find reason to believe that Americas PAC and Tom Donelson, in his official capacity as treasurer, and Restoration PAC and Sherry Gaskill, in her official capacity as treasurer, violated 52 U.S.C. §§ 30118(a) and 30104(b) by making and failing to report prohibited in-kind contributions.
e. Find reason to believe that Restoration PAC and Sherry Gaskill, in her official capacity as treasurer, violated 52 U.S.C. §§ 30118(a) and 30104(b) by making and failing to report prohibited in-kind contributions.
f. Direct the Office of General Counsel to draft Factual and Legal Analyses that reflect these findings.
g. Direct the Office of General Counsel to draft conciliation agreements with Leah Vukmir and Leah for Senate and Travis Kabrick, in his official capacity as treasurer, Richard Uihlein, Americas PAC and Tom Donelson, in his official capacity as treasurer, and Restoration PAC and Sherry Gaskill, in her official capacity as treasurer.
h. Approve the appropriate letters.
The Commission failed by a vote of 3-3 to:
a. Find no reason to believe that Leah Vukmir and Leah for Senate and Travis Kabrick, in his official capacity as treasurer, violated 52 U.S.C. § 30125(e)(1)(A) by soliciting excessive contributions.
b. Find no reason to believe that Leah for Senate and Travis Kabrick, in his official capacity as treasurer, violated 52 U.S.C. §§ 30116(f) and 30104(b) by receiving and failing to report excessive, prohibited in-kind contributions in the form of coordinated communications.
c. Find no reason to believe that Richard Uihlein violated 52 U.S.C. § 30116(a) by making excessive in-kind contributions.
d. Find no reason to believe that Americas PAC and Tom Donelson, in his official capacity as treasurer, and Restoration PAC and Sherry Gaskill, in her official capacity as treasurer, violated 52 U.S.C. §§ 30118(a) and 30104(b) by making and failing to report prohibited in-kind contributions.
e. Find no reason to believe that Restoration PAC and Sherry Gaskill, in her official capacity as treasurer, violated 52 U.S.C. §§ 30118(a) and 30104(b) by making and failing to report prohibited in-kind contributions.
f. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated March 9, 2020, subject to the edits last circulated by Vice Chair Dickerson’s Office on Thursday, November 4, 2021 at 1:05 p.m.
g. Send the appropriate letters.
h. Close the file.
