The Commission failed by a vote of 3-3 to:
a. Find reason to believe that Duncan D. Hunter, Margret Hunter, and Chris Marston in his official capacity as treasurer, knowingly and willfully violated 52 U.S.C. § 30114(b).
b. Find reason to believe that Duncan D. Hunter for Congress and Chris Marston in his official capacity as treasurer, knowingly and willfully violated 52 U.S.C. § 30104(b)(6)(a).
c. Enter into pre-probable cause conciliation with Duncan D. Hunter, Margaret Hunter, and Duncan D. Hunter for Congress and Chris Marston in his official capacity as treasurer.
d. Approve the appropriate letters.
e. Approve the proposed conciliation agreement, subject to revising it to include the Commission’s knowing and willful findings in the first paragraph.

a. Enter into pre-probable cause conciliation with Duncan D. Hunter, Margaret Hunter, and Duncan D. Hunter for Congress and Chris Marston in his official capacity as treasurer.
b. Approve the proposed conciliation agreement, subject to the edits circulated by Commissioner Cooksey’s Office on July 14, 2021 at 9:28 a.m. . . . REDACTED . . .

The Commission decided by a vote of 4-0 to hold the investigation in full abeyance until the conclusion of the Hunters’ criminal trial, contingent upon each Respondent entering into an agreement to toll the statute of limitations for the duration of the abatement, as recommended in the Memorandum from the Acting General Counsel dated February 21, 2019.
The Commission decided by a vote of 4-0 to:
1. Find reason to believe that Duncan D. Hunter for Congress and Chris Marston in his official capacity as treasurer, Rep. Duncan D. Hunter, and Margaret Hunter violated 52 U.S.C. § 30114(b).
2. Find reason to believe that Duncan D. Hunter for Congress and Chris Marston in his official capacity as treasurer violated 52 U.S.C. § 30104(b)(6)(A).
3. Approve the Factual and Legal Analyses, as recommended in the First General Counsel’s Report dated October 6, 2017.
