COMMISSION MEETINGS AND HEARINGS

No Commission open meetings or executive sessions were scheduled this week.

ADVISORY OPINIONS

Advisory Opinion Request

AOR 2014-05 (Henry Ford Health System Government Affairs Services PAC).  On July 3, the Commission made public Advisory Opinion Request 2014-05.  The requestor asks whether the PAC, the separate segregated fund of a subsidiary corporation, may solicit contributions from employees of the parent corporation and the parent's other subsidiaries, and whether the Federal Election Campaign Act of 1971, as amended (the Act), preempts certain provisions of Michigan law. The Commission must issue a response no later than 60 days after receipt of the complete request, or specifically by September 2, 2014.

AOR 2014-06 (Paul Ryan). On July 3, the Commission made public Advisory Opinion Request 2014-06. Congressman Paul Ryan, Ryan for Congress, Inc., and Prosperity Action, Inc. ask whether certain proposed activities relating to the publication, distribution, and promotion of a book written by Congressman Ryan are permitted under the Act and Commission regulations. The Commission must issue a response no later than 20 days after receipt of the complete request, or specifically by July 21, 2014, because this request was submitted by a federal candidate within 60 days before a federal election.

AOR 2014-07 (Crowdpac). On July 3, the Commission made public Advisory Opinion Request 2014-07. The requestor asks whether its planned web-based contribution platform is permissible under the Act and Commission regulations. The Commission must issue a response no later than 60 days after receipt of the complete request, or specifically by September 2, 2014.

AOR 2014-08 (Nick for New York). On July 3, the Commission made public Advisory Opinion Request 2014-08. Nicholas Di iorio and Nick for New York ask whether Mr. Di iorio, a candidate for the House of Representatives, may participate in a reality television show featuring candidates for office, and whether he may be paid in return for his participation. The Commission must issue a response no later than 60 days after receipt of the complete request, or specifically by September 2, 2014.

ADMINISTRATIVE FINES

The Commission made public one campaign finance enforcement matter that was resolved through its Administrative Fines (AF) program, as follows. For more information, see the case documents in the Enforcement Query System.

AF 2596 – Steve Hobbs for Congress and Jim Kainber, in his official capacity as treasurer. The Commission made a final determination and assessed a civil penalty of $990.

ALTERNATIVE DISPUTE RESOLUTION

The Commission made public one campaign finance enforcement matter that was resolved through its Alternative Dispute Resolution (ADR) program, as follows. For more information, see the case documents in the Enforcement Query System.

ADR 676 – American Bridge 21st Century and Rodell Mollineau, in his official capacity as treasurer. The respondent agreed to (1)certify that a representative of the Committee participated in an FEC conference, (2) develop and certify implementation of a compliance operations manual and a process to track receipt of, and response to, communications with the Commission, and (3) pay a civil penalty of $6,200.

UPCOMING COMMISSION MEETINGS

July 10: The Commission is scheduled to hold an open meeting. The Commission is also scheduled to hold an executive session, which has been rescheduled from July 8.
