COMMISSION MEETINGS

ADVISORY OPINIONS

Request Received

AOR 2010-09 (Club for Growth). On June 3, the Commission made public Advisory Opinion Request 2010-09, in which Club for Growth, a 501(c)(4) organization that is a qualified non-profit corporation under Commission regulations, asks whether a planned political committee which would be established and administered by Club for Growth, and which would only make independent expenditures, may solicit unlimited donations from the public at-large. Club for Growth also asks whether the planned political committee may solicit donations that are earmarked for specific independent expenditures. Finally, Club for Growth asks whether the Commission’s analysis would change if the planned political committee were to pay for its own establishment, administrative, and solicitation expenses rather than have those expenses paid for with Club for Growth’s general treasury funds. The Commission must issue a response no later than 60 days after receipt of the complete request, or by July 20.

ENFORCEMENT

The Commission made public one closed case this week. For more information, see the case documents in the Enforcement Query System.

MUR 5879 – Harry Mitchell for Congress and John Bebbling, in his official capacity as treasurer; and Democratic Congressional Campaign Committee and Jonathan S. Vogel, in his official capacity as treasurer. The Commission found no reason to believe Harry Mitchell for Congress and its treasurer violated the Federal Election Campaign Act of 1971, as amended. The Commission closed the file concerning the Democratic Congressional Campaign Committee and its treasurer.

LITIGATION

SpeechNow.org v. Federal Election Commission. On May 27, the United States District Court for the District of Columbia issued an order granting plaintiffs’ motion for entry of judgment permanently enjoining the Commission from enforcing the contribution limits addressed in the case against SpeechNow.org or those who would like to contribute to SpeechNow.org.
